Globecast Holding and its group companies (collectively “Globecast“) is committed to the protection, confidentiality and security of personal data and respects your right to privacy.

This Privacy Notice explains who we are, how we collect, share and use personal information about you, and how you can exercise your privacy rights.

When does this Notice apply?

This Privacy Notice applies in the following instances where we collect and process personal information as a data controller for our own purposes.  In particular, this Privacy Notice applies to personal information that we collect through our website (“Website”) and personal information that we may collect about employees of our customers, suppliers, and other third party individuals such as visitors who interact with us in a business context, whether online or offline.

Whenever we collect your personal information, we will either provide you with a separate notice that applies in those circumstances, or we will refer you to this Notice.

What does Globecast do?

Globecast opens up global opportunities in media services and broadcasting by making content distribution and management simple. This includes providing services in content contribution, media management, channel playout, distribution and providing events, production and transmission facilities on an international scale. We are headquartered in France but have group companies all around the world.

Who do we collect personal information from?

While we operate as a business-to-business company, we collect and use personal information about various categories of individuals in order to function, provide our services and to maintain a business relationship with our actual (or prospective) customers and suppliers.

In relation to this Privacy Notice, we collect and process personal information about:

1. Website visitors;
2. Employees of our Customers, Suppliers, Business Partners; and
3. Visitors and people we interact with for business purposes.

We generally obtain your personal data directly from you.  However, we may also collect information about you (including your company or employment role), by other means.  For example, we may collect business information about you from third party due diligence service providers, if we are carrying out due diligence about your company or employer, or we may be sent this by other individuals at your employer or company in the context of our commercial relationship.

What personal information does Globecast collect and why?

1. Website visitors

Information that you provide voluntarily

Certain parts of our Website may ask you to provide personal information voluntarily: for example, we may ask you to provide your contact details (including your first name, surname, title, company, address, telephone number and email address). We use this information:

• to periodically send you marketing communications from us, where permitted by law;

• to provide and improve our website or our services; and

2. Employees of Customers, Suppliers and Business Partners

• Contact details – such as business or delivery address, telephone/business email address, etc.
• Professional details – such as your job title/position, employer, etc.
• Financial characteristics from natural persons – such as account number and bank details, invoice address.
• National identifiers – such as tax ID and VAT number.
• Information relating to your working history with us.
• Other information you choose to provide to us during your interactions with us.
• IP addresses or other information that we may collect from you if you visit our Website (please see separate section about Website Visitors, above)

We may collect and use this personal information about you for the following purposes:

• For the purpose of general business relationship management within Globecast; for example contract management;
• To manage any queries, complaints or claims relating to the services you (or your employer) provide to Globecast, or that Globecast provides to you (or your employer);
• For direct marketing, advertising and public relations purposes, in connection with Globecast’s business activities, products and services (including, where permitted by law, to make recommendations about our services and products), and to inform about important developments within Globecast;
• For development purposes, to allow us to improve our services or develop new offerings;
• Where necessary to comply with laws and regulations, or to exercise or defend the legal rights of the Group companies;
• To help us conduct our business more effectively and efficiently or to check and improve the quality of our services;
• To carry out research and development with various Globecast partners;
• To investigate violations of law or breaches of other Globecast policies.

3. Visitors and people we connect with for business purposes

There might be occasions where we interact with people who are not regular contacts of ours. For example, we may hold or attend events or functions that are attended by our actual or prospective customers or suppliers and visitors. We may process the following personal information in these situations:

• Identification data – such as your first name, surname, date of birth, photograph.
• Contact details – such as email address, contact phone number.
• Professional details – such as your job title/position, employer, etc.
• Other information you choose to provide to us, for example the purpose of your visit if you visit us.

We may collect and use this personal information about you for the following purposes:

• For the management of our guest list;
• For safety regulations and reasons related to emergency evacuations and roll call;
• where permitted by law, for marketing and promotion of our events, business and activities.

Further uses of personal information

In general, we will use the personal information we collect from you only for the purposes described in this Privacy Notice or for purposes that we explain to you at the time we collect your personal information.  However, we may also use your personal information for other purposes that are not incompatible with the purposes we have disclosed to you if and where this is permitted by applicable data protection laws. Who does Globecast share my personal information with?

We may disclose your personal information to the following categories of recipients:

• to our group companies, affiliates, third party services providers and partners who participate in the processing of your personal data (for example, to support our marketing activities, or help to enhance the security of our Website), or who otherwise process personal information for purposes that are described in this Privacy Notice or notified to you when we collect your personal information.
• to any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;

Legal basis for processing personal information

Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it.

However, we will normally collect personal information from you only (i) where the processing is in our legitimate interests and not overridden by your rights, (ii) where we have your consent to do so or (iii) when we have a legal obligation.

If we collect and use your personal information in reliance on our legitimate interests (or those of any third party), this interest will normally be to operate our business, and communicate with you as necessary to provide our services and for our legitimate commercial interests, for instance, when responding to your queries, improving our services or Website, undertaking business to business marketing, or for the purposes of detecting or preventing illegal activities.

How does Globecast keep my personal information secure?

Globecast is committed to ensuring that your personal information remains secure and confidential. To this end, we have put appropriate technical and organisational measures in place to prevent the loss, misuse, alteration and deletion of your personal information. These measures ensure a level of security that is appropriate to the level of sensitivity of the processed information and to the level of risk given our use of such information.

International data transfers

Your personal information may be transferred to, and processed in, countries other than the country in which you are resident.  These countries may have data protection laws that are different to the laws of your country (and, in some cases, may not be as protective).

Specifically, our Website servers are located in the UK, and our group companies and third party service providers and partners operate around the world.  This means that when we collect your personal information we may process it in any of these countries.

However, Globecast has put appropriate safeguards in place to require that your personal information will remain protected in accordance with this Privacy Notice and applicable data protection law. These include implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies, which require all group companies to protect personal information they process from the EEA in accordance with European Union data protection law. We have also implemented similar appropriate safeguards with our third party service providers and partners.

Data retention

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide our services, to manage our relationship with your employer, or to comply with applicable legal, tax or accounting requirements); and in accordance with relevant statutory limitation periods.

When we have no ongoing legitimate business need to process your personal information (or no legal obligation to retain it), we will either delete or anonymise it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

• You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you.
• Similarly, if we have collected and process your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.
