By accessing to this Site, you fully accept these terms of use (hereinafter referred to as “TU” and you agree to abide by them without reserve.

1. Information about the Site

2. Site content

The content published on the Site is provided by Globecast, its affiliated companies, independent content providers or third parties. It is subject to the intellectual property rights of Globecast, Globecast affiliates or the relevant independent providers or third parties. Any reproduction, modification, transfer, distribution or storage of all or part of such content, in any form or by any means, is prohibited without Globecast prior written consent, unless it is made in accordance with the following conditions. Globecast accepts that the user visits the Site from its computer or that it prints extracts from the Site pages for its sole personal use, but under no circumstances for the purpose of redistribution without Globecast prior written consent. The access to some elements or parts of the Site can be subject to additional conditions, which would be mentioned on said elements or parts.
The Site and its content are made available to the user for practical purposes in order to provide him information regarding Globecast activities, products and services. The Site content is however provided “as it is” without any warranty whatsoever.

3. Links

To improve access to the Site, Globecast might include links to websites belonging or handled by third parties. The user undertakes to consult and accept the terms of use of said websites before using them. The user also acknowledges that Globecast does not make any control of the content of said websites and shall not be held liable for data created or published on them. Furthermore, a link which does not belong to Globecast does not imply that Globecast approves said third-party website, or the products or services which are listed on it.

4. Cookies

A cookie (or log file) is a small text file transferred from a site server when consulting
on-line services. Said cookie is saved on a user computer (PC or other device) thanks to the browser for the purpose of subsequent user identification. Cookies can be used to save user preferences and other user data when consulting a site. Under no circumstances a cookie might enable an individual identification. Globecast uses cookies in order to measure usage of the Site, for its sole internal needs. The user can either accept or refuse cookies. Most browsers automatically accept cookies, but generally users might change their browser’s settings in order to refuse cookies. If the user refuses cookies, it might not be able to access some interactive Site’s features.

5. Intellectual property

Globecast trademark and logo as well as any Globecast product or service name mentioned on the Site, are registered trademarks/logos of Globecast and/or on which Globecast holds copyrights or equivalent rights. The other trademarks or names mentioned on the Site might be registered by third parties or might be trademarks or names on which third parties hold copyrights. The access to the Site by the user shall not be interpreted as conferring the user any implied or express license or authorization on any trademark or name without Globecast’s or relevant third- party’s prior written consent.

6. Personal data

Any user having provided direct or indirect personal data on the Site can request the communication of its personal data and make them modified or deleted, in accordance with French Law No 78-17 of January 6, 1978. The user can either send an email to the following address: contact@globecast.com, or send a letter to Globecast: Communication Department, 5 allée Gustave Eiffel, 92136 Issy les Moulineaux cedex. Upon reception of said request, Globecast undertakes to modify or delete as requested, any personal data regarding the relevant user.

7. Non-personal data

Users’ non-personnal data will not be used for any other purpose and will be kept confidential within Globecast Group and its business partners. By “Globecast Group” it is hereby meant any entity which is directly or indirectly owned or controlled by Globecast Holding, Globecast’s mother company. For the purpose of this definition, the term “control”, as applied to all entity, shall mean, the direct or indirect, possession of at least twenty (20) % of voting right or the power to elect board directors or representative of this entity by means of contractual arrangements or otherwise. The user therefore accepts that Globecast discloses its non-personal data to any company belonging to Globecast Group and/or to Globecast business partners.

8. No warranty

NO WARRANTY WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTY OF TITLE, NON-INFRINGEMENT, OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IS GIVEN AS TO THE AVAILIABILITY, THE ACCURACY, THE RELIABILITY OR THE SITE CONTENT. IN NO EVENT SHALL GLOBECAST BE HELD LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, LOST SAVINGS, AND BUSINESS INTERRUPTION RESULTING FROM THE USE OR THE IMPOSSIBILITY TO USE THE SITE, EVEN IF GLOBECAST HAS BEEN ADVISED OF THE POTENTIAL OCCURENCE OF SUCH DAMAGES.
Some jurisdiction do not allow the exclusion of certain warranties or liability limitations, in this case, said warranty exclusion or liability limitations might not be applicable to certain users. In such case, Globecast liability will be limited to the maximum extent permitted by law.

9. Site accessibility and modification

The Site is accessible through Internet, which is independent from Globecast. The Internet use is under the user sole liability and is subject to all applicable law and regulations. Globecast shall not under any circumstances be liable for the information or services obtained by the user through the Internet.
If the user’s PC is not compatible with the appropriate technologies, including in terms of encryption, the user might not be able to use certain services or to access to certain information on the Site.
Globecast might interrupt all or part of the Site for any reason whatsoever, at any time and at its sole discretion.
Globecast shall not be held liable of any modification, suspension, interruption of the Site, or alteration of the access to the Site and its content, for any reason whatsoever.

10. TU modification

Globecast reserves the right to modifiy these TU from time to time, such modifications being effective immediately upon their posting on the Site. The user will be bound to have accepted the updated version of these TU each time it accesses or uses the Site.

11. Applicable law and jurisdiction

These TU are governed by French law.
Both Globecast and the user accept to irrevocably submit any disputes under these TU to the Paris courts, notwithstanding multiple defendants or the introduction of third parties, even for emergency or interim proceedings.
